Tommy Berry has been cleared of any wrongdoing but told to show more initiative and better judgment following an inquiry into his ride on beaten favourite Driefontein in last month's Wyong 3YO Magic Millions.
Stewards questioned Berry on race day about his handling of Driefontein after the short-priced favourite was caught in a pocket behind the leader during the run instead of holding the lead.
Berry said his instructions and intentions were to lead but was surprised when Cheers Rhianna moved around three-wide to assume the lead from him.
He said he couldn't see that runner on his outside until it was well past him.
When he was unable to hold the front he tried to urge Driefontein to push outside the lead but was pocketed by Corey Brown on the eventual winner She's A Stalker.
Stewards investigated betting records on the race and found no integrity issues.
"Whilst stewards did not deem jockey Berry's ride culpable, under the Rules of Racing he was nonetheless advised that he must show more initiative and greater judgment in future," a Racing NSW statement said.
Berry will ride Driefontein in Saturday week's $1 million Magic Millions 3YO Guineas (1400m) at the Gold Coast where the filly is second favourite behind Queensland colt Sizzling.
Berry rode Driefontein to win the $2 million Magic Millions Classic last year on protest over stablemate No Looking Back.
The jockey will be shooting for his third-straight Magic Millions 2YO Classic win when he rides Certitude.
Certitude races in the same purple colours with white stars of Denise Martin's Star Thoroughbreds syndications as her Gai Waterhouse-trained stablemate Driefontein.
