Blake Shinn's appeal against conviction and penalty for a careless riding charge will be held next Thursday, two days before he is scheduled to ride in the Magic Millions at the Gold Coast.
Shinn was outed at Randwick on New Year's Day with his original ban scheduled to start on Sunday and end on January 23.
He was granted a stay of proceedings pending the appeal.
Shinn has been booked to ride the Gai Waterhouse-trained Cyclone in the $2 million Magic Millions Classic.
Racing NSW stewards found Shinn guilty of shifting out and taking a run between horses that he wasn't entitled to claim.
Shinn argued there was enough room for his mount but stewards disagreed, saying he caused interference to Brenton Avdulla's horse Millars Crossing.
