Trainer Mark Riley is free to continue training until a hearing in the Victorian Supreme Court.
Riley was on Thursday granted leave to appeal his three year disqualification in the Supreme Court.
Mornington-based Riley was banned in February over an elevated bi-carb reading taken from Gold For Kev which contested a race at Sandown in July last year, finishing unplaced.
Riley was disqualified by the Racing Appeals and Disciplinary Board.
He had an appeal dismissed by the Victorian Civil and Administrative Tribunal in March before seeking leave to take his appeal to a higher jurisdiction.
