Thomas Huet will continue to ride until his appeal against a one-month improper riding ban is heard.
Huet was hit with the serious charge at an inquiry into an incident in a race at Wyong last week when stewards alleged he extended his right arm towards fellow rider Jess Taylor in a tight finish.
Despite Taylor's evidence that Huet did not make contact, stewards found otherwise and issued the heavy penalty.
Huet, 12th on the NSW premiership with 37 wins this season, has been given a stay of proceedings until his hearing on January 25.
