Racing Victoria will find out in June whether it will be granted leave to appeal the court decision which overturned trainer Danny O'Brien and Mark Kavanagh's bans in the long-running cobalt case.
Last month the Victorian Civil and Administrative Tribunal upheld O'Brien and Kavanagh's appeal against four and three-year bans respectively which were issued by the Racing Appeals and Disciplinary Board.
Racing Victoria is seeking leave to appeal the VCAT decision to the Court Of Appeal, with a bench of three judges to hear that application on June 9.
RV said if leave was granted on June 9, the appeal would be heard by the Court of Appeal the same day.
