On a day jockeys around the country have met to try to have the new whip rules delayed, Andrew Banks has been found guilty of using it 40 times on a horse at Rosehill.
Banks, who is trying to re-establish himself after a lengthy disqualification for a drug-related issue, came fourth on Mandalong Kiss in a 1350m race on Saturday.
While riders and trainers in other jurisdictions held meetings throughout the day, NSW chief steward Ray Murrihy directed they would not be held until after the last races around the state.
The new rule to be introduced on December 1 means jockeys will only be allowed to use the whip five times before the 100m in either a forehand or backhand manner.
After the introduction of rules introduced in 2009 to coincide with padded whips, jockeys were allowed to use a backhand action without restriction.
After fining Banks $300, Murrihy said his use had been excessive and cited other examples during the meeting.
"We have had three incidents today where the whip has been used by people on close finishes," Murrihy said.
"We need to be cognisant of the welfare issues. We have seen what has happened in other codes regarding welfare."
